On September 12, Professor Jonnette Watson Hamilton spoke to the Residential Real Estate Section of the Canadian Bar Association -- Alberta (South) branch about dower rights, specific performance, and the 2008 amendments to section 170 of the Land Titles Act. She commented on deficiencies in paragraphs 10.7 (dower) and 9.3 (specific performance as a buyer's remedy) of the Alberta Real Estate Association's (AREA) Residential Real Eestate Purchase Contract and on the need for changes to conveyancing practices as a result of the conditions imposed on immediate indefeasibility by the amendments to section 170. Watch for an ABlawg post on the latter problem -- coming soon.
